Cookies and Tracking Technologies Policy

Fernando Adolfo Ambordt, CUIT 20-30238683-9, with address at Enrique Bodereau 7491, X5147, City of Córdoba, Province of Córdoba, Argentine Republic, trading under the name “àndale” (“àndale”), hereby gives notice of the use of cookies and equivalent technologies on the website weareandale.com (the “Site”).

This Policy supplements the Privacy and Personal Data Protection Policy, available at weareandale.com/privacy, to which reference should be made as regards purposes, the rights of the data subject and the procedure for exercising them.

Cookies are small text files that websites store on the user’s device and that allow information about their browsing to be retrieved. Under the generic term “cookies” this Policy also covers other technologies of analogous function, such as tracking pixels, web beacons, device identifiers, third-party scripts and browser local storage (local storage and session storage).

Cookies may process personal data to the extent that they allow a natural person to be identified or made identifiable, in which case Ley N.° 25.326, the Argentine Personal Data Protection Act, and its supplementary rules apply.

The Argentine Republic does not at present have a specific rule governing the use of cookies. Accordingly, àndale applies the general regime of Ley N.° 25.326 and, as a voluntary standard of higher protection, the criteria of Directive 2002/58/EC and of Regulation (EU) 2016/679 (GDPR), which additionally apply directly in respect of users located in the European Economic Area and the United Kingdom.

On that basis:

• Technical or strictly necessary cookies: installed without requiring consent, being indispensable for the provision of the service expressly requested by the user.
• Analytics, personalisation and advertising cookies: installed only with the free, specific, informed and unambiguous prior consent of the user, given by an affirmative action through the Site’s configuration panel.

Consent is not presumed from the mere continuation of browsing, from scrolling the page or from closing the notice. No pre-ticked boxes or design patterns that make refusal harder are used: refusing all non-essential cookies takes the same number of actions as accepting them.

Set out below is the inventory of cookies and technologies used on the Site as at the date this Policy was last updated.

On first accessing the Site, the user is shown a notice allowing them to accept all cookies, to refuse them as a block — with the exception of the strictly necessary ones — or to configure their preference by category.

The user may change or withdraw their decision at any time and at no cost, with the same ease with which it was given, through the configuration panel permanently available from the “Cookie preferences” link in the footer, on every page of the Site. Withdrawal does not affect the lawfulness of processing carried out beforehand.

The record of consents given and withdrawn is kept for the period necessary to evidence compliance to the supervisory authority. After six (6) months without renewal, the notice will be shown again.

Independently of the Site’s panel, the user may block, restrict or delete cookies through their browser settings. The corresponding instructions are available in each browser’s help centre:

• Mozilla Firefox: Settings › Privacy & Security › Cookies and Site Data.
• Safari: Preferences › Privacy › Manage Website Data.
• Microsoft Edge: Settings › Cookies and site permissions.

The Site also observes privacy preference signals transmitted by the browser, such as Global Privacy Control (GPC): where that signal is detected, the non-essential categories remain switched off without any action by the user.

Refusing non-essential cookies does not prevent access to the Site or to its content. It may, however, affect the operation of certain features, such as the memory of preferences or the playback of embedded third-party content, and it limits àndale’s ability to measure and improve the browsing experience.

Third-party cookies are installed and managed by the providers identified in clause 5, who autonomously determine the purposes and means of processing the information collected through them. àndale does not control that processing and recommends that the user consult each provider’s privacy policy.

Since several of those providers are established outside the Argentine Republic, accepting the corresponding cookies may involve an international transfer of data, subject to Article 12 of Ley N.° 25.326 and to AAIP Resolution N.° 159/2018.

The user may exercise the rights of access, rectification, updating, deletion and objection in respect of personal data processed by means of cookies, on the terms of Articles 14 to 16 of Ley N.° 25.326 and in accordance with the procedure described in the Privacy Policy, by addressing their request to privacy@weareandale.com.

The Agencia de Acceso a la Información Pública, as the supervisory body under Ley N.° 25.326, has the power to hear complaints and claims brought by those whose rights are affected by non-compliance with the rules in force on personal data protection.

àndale may amend this Policy in the event of regulatory or technical changes or changes in the third-party services used. The version in force will be the one published at weareandale.com/cookies, with an indication of the date it was last updated. Users are advised to consult it periodically.
